A guide for students and future teachers who are including outside materials as part of their own multimedia projects

License Agreements

Although Seton Hill has subscribed to a number of online journals which give users access to full text, the use of these journals is not unrestricted.  Our fees are based on the number of users, which only includes faculty, staff and current students.  There are also limits on how an individual may use the materials.  Most licenses prohibit copying of materials directly into a course management system.  Links to a journal are usually acceptable because the students will have to be authenticated through the library website in order to access the materials.

Here are some typical license provisions:

Participating Library and its Authorized Users shall not:

  • remove, obscure or alter any copyright or other notices, trademarks, logos, service marks or any other proprietary rights appearing in or on the Licensed Materials,
  • update, change, revise, adapt, modify, translate, transform or create any derivative work of the Licensed Materials,
  • re-distribute, reproduce, or transmit the Licensed Materials by any means including electronic (e.g., via e-mail) nor post it on their personal or public websites or on public networks,
  • systematically download any Licensed Materials, use routines designed to continuously and automatically search and index the Licensed Materials (full text and meta data), such as web-crawling or spider programs or engage in any activity likely to burden publisher’s websites,
  • directly or indirectly use or assist any third party to use the Licensed Materials for any commercial or monetary purposes including without limitation any sale, resale, loan, transfer or upload of the Licensed Materials to a commercial entity’s internet website, or otherwise charge a fee for access, provided however, that recovery of direct costs by Participating Library from Authorized Users, and use of the Licensed Materials in the course of research funded by a commercial organization shall not violate this sub-section.

Rights and Obligations of Participating Institutions  Participating Institution shall use best efforts to ensure that access and use of the Licensed Materials is limited to Authorized Users and that all Authorized Users are notified of and comply with the usage restrictions set forth in these Terms and Conditions.
